Is severance pay due, and how many months? After at least 3 years of employment, when the employer gives notice or ceases to exist without a legal successor.
The rule in brief
When is it due?
When employment ends by the employer's notice or because the employer ceases to exist without a legal successor, and it lasted at least 3 years (Mt. 77. § (1)-(2)).
How much?
1 month's absence pay after 3 years, 2 after 5, 3 after 8, 4 after 10, 5 after 15 and 6 months after 20 years (Mt. 77. § (3)).
More before retirement
If employment ends within 5 years before the employee becomes entitled to an old-age pension, severance rises by 1-3 months' absence pay (Mt. 77. § (4)).
When is it not due?
It is not due if the employee counts as a pensioner, or if the reason for notice is the employee's conduct in relation to the employment or their ability not related to health (Mt. 77. § (5)).
